Is the spouse and taxpayer adjusted gross Income the same if you filed married filing jointly?
Q. I am trying to efile, we filed married filing jointly last year, do I enter the same amount for both our AGI's or do I put the AGI as the taxpayer and zero for the spouse lines? We put the same amount in on Friday and it got rejected. We did end up doing a 1040X for 2007, those are the amounts we used, but got rejected. We are currently trying to use just the 1040 AGI and have not gotten acceptance back yet.

A. If you filed a joint return last year, then your AGI is the same as for your wife's AGI. For example, if your AGI from last year return was $18000, then when asked about your wife's AGI from last year, you would want to put the same number in.

A. Good luck, the local authorities are your best bet unless you signed the check. The IRS will not do anything unless fraud is included as in he forged your signature, the bank could be liable if they accepted a forged signature. You would have to prove it was a forge and the bank knew it. IRS won't really do anything as it is a civil case.

A. The beneficiary is the person/persons named on the account. Named by the owner of the account. The living spouse might protest this and bring this protest to 'estate' court. If the will/account and estate is in proper order and no 'hanky-panky' was involved, then the spouse hasn't a prayer. On the other hand, if no beneficiary was named by the owner, then the spouse is the beneficiary. And of course, other can protest this a bring it to 'estate' court. And again, if all is in order and there was no 'hanky-panky', then the spouse gets the accounts.

A. It is not enough to file separate returns in a community property state, in order to separate the tax liabilities of the spouses. If the tax owed was on community income, as defined by the State of California, and the spouse that did not owe tax did not apply for equitable relief as an "innocent spouse" using Form 8857, then the IRS is going to collect taxes from either spouse. If the tax owed was on separate income, as defined by the State of California, then only the person with that income is liable for the tax, unless that person has filed a joint return, and then the spouse is also liable for the tax.

A. well it all depends on her actions, I mean if he/she is reminding you to take your medicine, put on your seat belt,etc.. they are doing it out of concern of your well being. But if they are treating like a kid then you need to step out and let them know you are not heir child, but their equal. but make sure of it, since having some one care for you, is not a bad thing. Try not to make it a big deal, instead play daddy/mommy to her, maybe she/he will see how annoying her/his action come across. A. The military can't legally punish her because she is a civilian and a civilian is not subject to UCMJ. They can kick her off post and bar her from returning, though. However, it is still a crime to lie on an official statement, especially in order to get someone in trouble. If she is caught she could possibly face criminal charges in a civilian court.

A. Injured Spouse claims are not processed on any set schedule. Refunds are released, usually by check, when they are complete. It's been my experience that few people are satisfied with the program, which is traditionally the best indicator that it's actually working properly.

My injured spouse claim was not filed correctly and Colorado kept the refund. Any way to retrieve it?

I submitted the injured spouse form at a later date and I will be getting my Federal refund soon, but CO kept $600 and gave it to the child support office in our state to pay some of my husband's child support arrears. I don't want the money back from the child's mother, but am wondering had the injured form been filed properly, would this money have been taken out regardless? A. If you file the form again and Colorado honors it, they *will* ask the mother for the money back. No, you can't demand that the preparer give you the money instead. If federal did the form correctly and the state didn't, I suspect an error in one of the tax authorities instead of the paperwork.
